SmartLabs(Enotech Medical Solutions PVT LTD) respects the privacy of each Customer. SmartLabs(Enotech Medical Solutions PVT LTD) has established this Privacy Policy to explain how Data is collected by SmartLabs(Enotech Medical Solutions PVT LTD), and how this Data is used and disclosed. SmartLabs(Enotech Medical Solutions PVT LTD) takes the protection of Personal Information very seriously. COLLECTION

Collection on registration Once a Customer registers with SmartLabs(Enotech Medical Solutions PVT LTD), a Customer is not anonymous to SmartLabs(Enotech Medical Solutions PVT LTD). When registering, each Customer provides Data, which includes an ID, a password, and an email address. To combat online fraud, SmartLabs(Enotech Medical Solutions PVT LTD) may also record the IP address of a Customer when adding Data. In addition, a Customer may provide necessary Personal Information to process a credit card payment, including a billing address.

 

Decline to share

A Customer can decline to share Personal Information with SmartLabs(Enotech Medical Solutions PVT LTD) by not registering with SmartLabs(Enotech Medical Solutions PVT LTD).

 

Children

SmartLabs(Enotech Medical Solutions PVT LTD) does not intentionally gather Personal Information about visitors who are under the age of 13.

 

Collection from browser

Accordingly, a subsequent web site that collects URL information may log some Personal Information.

 

USE

Communications

SmartLabs(Enotech Medical Solutions PVT LTD) may call a customer if and when the customer has interacted with its website or provided it with his phone number through any channel, either online or offline. Customer can choose to ask the caller from SmartLabs(Enotech Medical Solutions PVT LTD) to not call him in the future, which will be honored and followed as per the the customer's request. The customer may still be sent promotional messages.

 

Messages and updates

SmartLabs(Enotech Medical Solutions PVT LTD) may send to a Customer administrative messages and email updates regarding its account, the web site, or Services. In some cases, SmartLabs(Enotech Medical Solutions PVT LTD) may also send a Customer primarily promotional messages. A Customer can choose to opt-out of promotional messages.

Personal Information may be used to improve the web site. While a Customer is logged into the web site, SmartLabs(Enotech Medical Solutions PVT LTD) may display targeted adverts and other relevant information based on the Data. Advertisers receive a record of the total number of impressions and clicks for each advert. They do not receive any Personal Information. If a Customer clicks on an advert, SmartLabs(Enotech Medical Solutions PVT LTD) may send a referring URL to the advertiser's site identifying that a Customer is visiting from the web site. SmartLabs(Enotech Medical Solutions PVT LTD) does not send Personal Information to advertisers with the referring URL. Once a Customer is on the advertiser's site however, the advertiser may collect Personal Information.

 

DISCLOSURE

SmartLabs(Enotech Medical Solutions PVT LTD) will not sell, share, or distribute Personal Information. No Personal Information may be disclosed to anyone except as provided in this Privacy Policy.

Affiliates

SmartLabs(Enotech Medical Solutions PVT LTD) may share Data with an Affiliate, in which case SmartLabs(Enotech Medical Solutions PVT LTD) will seek to require the Affiliates to honour this Privacy Policy.

 

Change of ownership

If SmartLabs(Enotech Medical Solutions PVT LTD) undergoes a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, SmartLabs(Enotech Medical Solutions PVT LTD) may assign its rights to the Data it processes to a successor, purchaser, or separate entity. SmartLabs(Enotech Medical Solutions PVT LTD) will notify each Customer of the transfer and the Customer may choose to modify its Personal Data at that time. If a Customer is concerned about its Data migrating to a new owner, the User may deactivate or delete its account.

 

Employees

SmartLabs(Enotech Medical Solutions PVT LTD) may need to disclose Data to its employees that require the Data to do their jobs.

 

Abuse

SmartLabs(Enotech Medical Solutions PVT LTD) may disclose Data to designated third parties to resolve or investigate abuse complaints. SmartLabs(Enotech Medical Solutions PVT LTD) may release Data to assist in attempting to block an abusive Customer or complain to its Internet Service Provider of an abusive Customer.

 

SECURITY OF DATA

SmartLabs(Enotech Medical Solutions PVT LTD) uses some of the most advanced security measures to protect the Data under its control. All Data is safe, secure, and available only to the Customer and those to whom Customer has granted permissions. In addition, the web site is hosted in a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders.

 

USERNAME AND PASSWORD

During the registration process, SmartLabs(Enotech Medical Solutions PVT LTD) may provide Customer with a username and password. It is the responsibility of each Customer to maintain the confidentiality and security of their password.

 

UPDATING OR REMOVING

A Customer may choose to correct or update the Data they have submitted to SmartLabs(Enotech Medical Solutions PVT LTD), by going to their account. To remove any Data from the active database of SmartLabs(Enotech Medical Solutions PVT LTD), a User may deactivate or delete their account. Even if a Customer updates or removes their Data from SmartLabs(Enotech Medical Solutions PVT LTD)'s live database, Data may be retained in SmartLabs(Enotech Medical Solutions PVT LTD)'s backup files and archives.

 

UNAUTHORISED USE

Any unauthorised use of SmartLabs(Enotech Medical Solutions PVT LTD) information systems is a violation of the Agreement and certain laws, including the section 86 of the ECT Act. Such violations may subject the person to civil and criminal penalties.

 

INTERCEPT AND MONITOR

SmartLabs(Enotech Medical Solutions PVT LTD) may intercept, monitor, block, filter, read, delete, and disclose any communication over its information system.

 

LIMITATION

SmartLabs(Enotech Medical Solutions PVT LTD) is not responsible for, gives no warranties, nor makes any representations in respect of the privacy policies or practices of linked or any third party web sites.

 

INTERNATIONAL CUSTOMERS

SmartLabs(Enotech Medical Solutions PVT LTD) may transmit or transfer Personal Information outside the resident jurisdiction of the Customer and therefore across borders. Personal Information may be stored on servers located in countries where laws protecting Personal Information may not be as stringent as the laws in the jurisdiction of the Customer. Personal Information may be processed by SmartLabs(Enotech Medical Solutions PVT LTD) in the country where it was collected as well as other countries where laws regarding processing of Personal Information may be less stringent.

SERVICE DELIVERY & PAYMENTS

The following terms and conditions for service delivery and payment shall govern all services delivery. Any conflicting purchasing terms and conditions of the Customer are hereby expressly rejected. Any such purchasing terms and conditions shall apply only if we expressly confirm them in writing. Booking with us shall be deemed acknowledgement of our terms and conditions.

1. Prices/Terms and Conditions of Payment:
• If payment deadlines are not met, this will automatically give rise to all of the statutory consequences of default, without any special reminder being required. In particular, we reserve the right to charge interest at the applicable rate charged by our bank if such interest exceeds the interest rate prescribed by statute (8% above the reference interest rate). Furthermore, the entire balance shall become due and payable immediately, irrespective of any payment targets.
• In the case of custom-made packages, we reserve the right to increase the price by a reasonable amount and to deviate to a reasonable extent from the agreed quantity.
3. Delivery Dates: We will endeavor to adhere to stipulated report-delivery deadlines. However, due to the hazards and peculiar features of lab testing, report-delivery deadlines will not be binding unless expressly agreed otherwise. Our contractual obligations are subject to the concerned labs delivering the correct report to us on time.
5. Passing of Risk: When samples are transported to the lab, the risk (of accidental loss, destruction or deterioration) (the "Risk") shall pass to the testing lab as soon as we have delivered the samples to the lab.
7. Errors in Report:
• If, despite the greatest of care being taken, the reports give rise to complaints, then, obvious errors must be notified without delay, in any case no later than 14 days after receipt of the report, and hidden errors must be notified without delay after their discovery, otherwise the reports shall be deemed accepted.
• If subsequent performance cannot be rendered, the Customer may – notwithstanding any claims for compensatory damages – rescind the agreement or reduce the contractual fee. The Customer may not demand compensation for expenses incurred in vain.
• For loss or damage caused by delay due to ordinary negligence, we shall be liable for up to only 5% of the booking price agreed with us.
9. Documents: Documents supplied by us may not be copied or made available to third parties, or used for any purpose other than the agreed purpose.
11. Relevant Information regarding Electronic Commerce: In case we use electronic means for the conclusion of a booking with regard to any of services (“e-commerce”) the Customer waives its rights regarding a) availability and explanation of a system to recognize and correct input errors before submitting an order and b) the supply of information regarding (i) the necessary steps to conclude a booking, (ii) electronic storage of the booking so concluded and its accessibility to the Customer, (iii) the possible languages available for booking.
13. Applicable Law and Judicial Forum:
• Substantive laws of Republic of India shall apply to all legal relationships and transactions established by this purchase agreement.
• The judicial forum for both parties, including for bill of contract matters, is our principal place of business (registered office). If we become the plaintiff in litigation, then we are also entitled to bring an action in the jurisdiction of the Customer's principal place of business (registered office).
